Attorney General issues updated guidance on Kentucky open records

County judge/executives are required to distribute materials

Following legislation earlier this year amending Kentucky's open records and open meetings laws, the Office of the Attorney General is required to distribute the updated information to certain local officials, including county judge/executives and county attorneys. As in years past, the Office of the Attorney General has asked KACo to assist with distributing these materials:

  1. The Kentucky Open Records and Open Meetings Acts: A guide for the public and public agencies (Updated Sept. 2025)
  2. Managing Government Records

The county judge/executive, or their designee, is required to distribute the materials (either by email or hard copy) within 60 days to all elected appointed officials in the county.

The required recipients include all elected officials, members of county legislative bodies, local government boards, commissions, authorities, committees, and special district boards. See KRS 65.055. Judges are also required to distribute the most recently updated information to newly elected or appointed officials within 60 days of the start of their term in office.

In addition, the judge must maintain a signed form verifying that each official has received the updated open records information:

Finally, the judge must certify to the Office of the Attorney General that the information has been distributed as required.
